Welcome to Soulmate (“we,” “us,” or “our”), an app that provides an AI Soulmate powered by OpenAI for users to engage in text-based conversations for companionship, entertainment, or general guidance. Users do not chat directly with each other; all interactions are with the AI Soulmate. By accessing or using the Soulmate mobile application (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

1. Eligibility

  • The App is intended for users aged 18 and older for legal reasons, and you agree to this restriction by using the App.
  • By using the App, you represent that you comply with all applicable laws (including US laws like CCPA and COPPA) and agree to use the App lawfully.
  • We strive to make the App accessible to all eligible users, including those with disabilities. The App, including its text-based AI Soulmate chat interface, supports screen readers (e.g., VoiceOver on iOS, TalkBack on Android) to comply with accessibility standards like WCAG 2.1. 2. Account and Profile

  • You must provide accurate and complete information when creating your account and profile. We do not collect relationship status (e.g., single, married, divorced).
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account, including ensuring compliance with the 18+ restriction.
  • We may suspend or terminate your account if you provide false information, create fake profiles, or violate these Terms or our Community Guidelines.

3. App Usage Rules

You agree not to:

  • Use the App for illegal, immoral, harassing, or harmful purposes.
  • Share inappropriate, offensive, or fraudulent content in profiles or text-based chats with the AI Soulmate.
  • Misrepresent your identity or intentions.
  • Attempt to reverse-engineer, hack, or misuse the App’s AI algorithms or systems.
  • Engage in behavior that violates our Community Guidelines (available at https://mysoulmate.app/community-guidelines).

We reserve the right to review, moderate, or remove content and terminate accounts for violations. We may report illegal activities (e.g., fraud, harassment, suspected underage use) to law enforcement in the UK, US, or other jurisdictions to ensure lawful operation.

4. AI Chat Disclaimer and Indemnification

The App uses AI, powered by OpenAI, to provide a conversational experience with the AI Soulmate based on your preferences, behavior, and AI chat data. AI chat data (e.g., your text messages) is used solely to improve the chat experience and conversational functionality. These conversations are provided for companionship, entertainment, and general guidance purposes only and are not guaranteed to be accurate, suitable, or reflective of human interaction. Results may vary, and we do not guarantee any specific outcomes from your conversations. They do not constitute professional advice (e.g., psychological, therapeutic, or relationship counseling). We are not liable for any actions, decisions, or outcomes resulting from your use of the AI Soulmate’s responses, and you use the App at your own risk.

By using the App, you:

  • Accept all responsibility for your use of AI-generated responses and chat interactions.
  • Indemnify and hold harmless Soulmate, its affiliates, and OpenAI from any harm, loss, or damages resulting from your misuse of the App or reliance on AI-generated content.
  • Agree that any illegal or immoral use of the App, including but not limited to fraud, harassment, or sharing unlawful content, is strictly prohibited and may result in account termination and reporting to law enforcement.

5. Premium Features and Payments

  • The App offers free and premium features (e.g., enhanced AI chat capabilities, additional conversation modes). The free version may include ads to support the App’s operation, and you can opt out of personalized ads via Google’s settings (see Privacy Policy) or by emailing [email protected]. Premium features require payment of applicable fees, as described in the App.
  • Subscriptions auto-renew unless canceled at least 24 hours before the renewal date via your Google Play or Apple App Store account settings. Pricing and terms are displayed before purchase.
  • Payments for premium features are processed by Stripe, a third-party payment processor. Stripe handles your payment data securely in compliance with PCI DSS and applicable laws. We do not store your payment information. See Stripe’s Terms of Service and Privacy Policy for details.
  • Refunds are subject to our Refund Policy, available at https://mysoulmate.app/refund-policy.

6. User-Generated Content

  • You retain ownership of text-based content you submit (e.g., profile details, AI chat messages).
  • By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and store your content to operate the App and provide AI-driven conversational services.
  • You are responsible for ensuring your content complies with these Terms, our Community Guidelines, and applicable laws, including prohibitions on illegal or immoral content.

7. Intellectual Property

All App content, including AI algorithms, designs, and trademarks, is owned by or licensed to us. You may not copy, modify, or distribute any part of the App without our permission.

8. Third-Party Services

The App uses third-party services, including OpenAI for AI conversational functionality, Google Ads for advertising, Google Analytics for usage insights, and Stripe for payment processing (for premium users). These services are subject to their own terms and privacy policies, which you should review. You can opt out of personalized ads via Google’s settings (e.g., myadcenter.google.com).

9. Termination

We may suspend or terminate your access to the App at our discretion, including for violations of these Terms, Community Guidelines, or suspected underage use, without notice or refund.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any damages arising from your use of the App, including reliance on AI-generated responses. The App is provided “as is” without warranties of any kind.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.

12. Changes to These Terms

We may update these Terms to reflect changes in our practices or legal requirements. We will notify you via the App or website. We recommend consulting a legal professional to ensure these Terms comply with all applicable laws, including those related to OpenAI’s and Stripe’s data processing.
