Soulmate (“we,” “us,” or “our”) operates the Soulmate mobile application (the “App”), which provides an AI Soulmate powered by OpenAI for users to engage in text-based conversations for companionship, entertainment, or general guidance. Users do not chat directly with each other; all interactions are with the AI Soulmate. This Privacy Policy explains how we collect, use, disclose, and protect your personal information in compliance with applicable laws, including the UK General Data Protection Regulation (UK GDPR), EU General Data Protection Regulation (EU GDPR), California Consumer Privacy Act (CCPA), other US state privacy laws (e.g., Virginia Consumer Data Protection Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act), Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Australia’s Privacy Act 1988, the US Children’s Online Privacy Protection Act (COPPA), and the policies of Google Play, Apple App Store, and Google Ads. The App is advertised in the United States but available to users in English-speaking countries.

1. Information We Collect

We collect the following types of information:

  • Personal Information: Name, email address, phone number, gender, profession, education, religion, location, and other profile details you provide during registration or use of the App. We do not collect relationship status (e.g., single, married, divorced).
  • Sensitive Information: Preferences or other data you voluntarily share in the AI chat (e.g., interests, hobbies, topics of conversation), collected with your explicit consent and used solely to enhance your conversational experience with the AI Soulmate.
  • AI Chat Data: Text messages, preferences, or other inputs you provide in the AI chat with the Soulmate AI, used solely to tailor the AI’s responses to your needs (e.g., providing more relevant or engaging conversations).
  • Device Information: IP address, device type, operating system, browser type, and Advertising ID (if applicable).
  • Usage Data: Interactions with the App, such as search queries, profile views, and engagement with the AI chat.
  • Payment Information (Premium Users): For premium users, payment data (e.g., credit card details) is collected and processed by Stripe, our third-party payment processor, to facilitate subscriptions or in-app purchases. We do not store your payment information.
  • Third-Party Data: Data collected via third-party services, such as Google Analytics for app usage, Google Ads for personalized advertising, or OpenAI for AI conversation functionality.

2. How We Collect Information

  • Directly from You: When you register, create a profile, or use the AI chat feature (text-based only). We collect sensitive information and AI chat data only with your explicit consent, provided via an in-app consent popup during onboarding or in settings. The consent popup states: “I consent to Soulmate using my AI chat data to personalize my conversational experience. This data will not be used for advertising or sold.” You can withdraw consent at any time via in-app settings.
  • Automatically: Through cookies, Advertising IDs, and device sensors (e.g., for location-based personalization of conversations, if applicable).
  • Third Parties: Via analytics tools, ad networks, Stripe (for premium users’ payment processing), or OpenAI, which processes AI chat data for conversational functionality on our behalf under data processing agreements.

3. How We Use Your Information

We use your information to:

  • Provide and personalize your conversational experience with the AI Soulmate, powered by OpenAI.
  • Use AI chat data (e.g., your text messages, preferences) solely to tailor the AI’s responses to your needs, such as providing more relevant, engaging, or supportive conversations. AI chat data is not used for advertising purposes or sold.
  • Display personalized ads in the free version of the App to support its operation, via Google Ads or other ad networks, using data like Advertising ID (but not AI chat data).
  • Analyze app performance and improve user experience via tools like Google Analytics (excluding AI chat data).
  • Process payments for premium users via Stripe, ensuring secure transactions for subscriptions or in-app purchases.
  • Comply with legal obligations and protect user safety, including reporting misuse to law enforcement where required.

4. How We Share Your Information

We may share your information with:

  • Service Providers: Third-party providers, such as OpenAI for AI conversational functionality (including processing AI chat data), Google Analytics for usage data, Google Ads for advertising, or Stripe for payment processing (for premium users). These providers process data on our behalf under data processing agreements. OpenAI does not use AI chat data for advertising or sell it. Stripe processes payment data securely and does not share it with us beyond what is necessary to complete transactions.
  • Ad Networks: For personalized ads in the free version, we share limited data like Advertising IDs (but not AI chat data), subject to your consent (where required, e.g., UK/EU GDPR) or opt-out rights (e.g., CCPA).
  • Legal Authorities: If required to comply with laws, respond to legal requests, or protect user safety, including reporting illegal activities (e.g., fraud, harassment, suspected underage use) to law enforcement in the UK, US, or other jurisdictions.
  • Note: Since users do not chat directly with each other, no user data is shared with other users.

5. Personalized Advertising

The free version of the App may display personalized ads to support its operation, using your Advertising ID or other data (excluding AI chat data). We use Google Ads, and our app complies with Google Ads requirements by using Google Mobile Ads SDK version 20.4.0 or higher, supporting Privacy Sandbox and opt-out mechanisms for Android 13+. You can opt out of personalized ads directly through Google’s settings or by contacting us:

Google Opt-Out:

  • Android: Go to Settings > Privacy > Ads (or Settings > Google > Ads) to reset your Advertising ID or opt out of Ads Personalization. For Android 13+, you can manage Privacy Sandbox settings (e.g., Topics, Protected Audience APIs) under Settings > Privacy > Ads by Google > Ads Services.
  • iOS: Go to Settings > Privacy > Tracking and disable “Allow Apps to Request to Track,” or turn off “Personalized Ads” under Settings > Privacy > Apple Advertising.
  • Google Account: Visit myadcenter.google.com or adsettings.google.com to turn off Personalized Ads or manage ad preferences.

Soulmate Opt-Out: To opt out of data sharing for ads, email [email protected] with your request. We will process your opt-out within 10 business days, as required by CCPA.

6. AI Chat Disclaimer

The App uses AI, powered by OpenAI, to provide a conversational experience with the AI Soulmate based on your preferences, behavior, and AI chat data. These conversations are provided for companionship, entertainment, and general guidance purposes only and are not guaranteed to be accurate, suitable, or reflective of human interaction. Results may vary, and we do not guarantee any specific outcomes from your conversations. They do not constitute professional advice (e.g., psychological, therapeutic, or relationship counseling). We are not liable for any actions, decisions, or outcomes resulting from your use of the AI Soulmate’s responses, and you use the App at your own risk. You should exercise your own judgment before acting on any AI-generated responses.

7. Your Data Protection Rights

Depending on your location, you have rights under UK GDPR, EU GDPR, CCPA, other US state laws (e.g., VCDPA, CPA, CTDPA, UCPA), PIPEDA, or Australia’s Privacy Act, including:

  • Access: Request a copy of your personal data.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Request deletion of your personal data.
  • Restriction: Request restriction of data processing in certain cases.
  • Data Portability: Request your data in a portable format.
  • Opt-Out: Opt out of data sharing, personalized ads, or AI processing of sensitive data.
  • Objection: Object to data processing for specific purposes (e.g., marketing).
  • Non-Discrimination: You will not be discriminated against for exercising your rights.

You may initiate deletion via in-app settings, but email confirmation is required. We will respond within one month (extendable to two months for complex requests under UK/EU GDPR) or within 45 days (extendable to 90 days under CCPA).

8. Data Deletion and Correction Process

  • Deletion: To delete your data, submit a request to [email protected] with your account details. After receiving our confirmation, you may use the in-app deletion feature. We will delete your data within 30 days (or 45 days under CCPA), unless required by law to retain it. Anonymized data may be retained for analytics.
  • Correction: To correct inaccurate data, email [email protected] with details of the correction needed. We will verify and confirm the request before updating your data within 30 days (or 45 days under CCPA).

9. Children’s Privacy

The App is intended for users aged 18 and older for legal reasons, and you agree to this restriction by using the App. We do not knowingly collect data from children under 13 (in compliance with COPPA) or under 16 in certain regions (in compliance with UK/EU GDPR). If you believe a child under these ages has used the App and we have collected their data, contact us immediately at [email protected], and we will terminate the account and delete the data.

10. Data Security

We use industry-standard encryption to protect your data, including secure communication channels for text-based interactions with the AI Soulmate, in compliance with the US Federal Trade Commission Act (FTC Act), Electronic Communications Privacy Act (ECPA), and other laws. OpenAI, our AI provider, processes AI chat data in compliance with security standards (e.g., ISO 27001) under our data processing agreement, ensuring the protection of your sensitive information. Stripe processes payment data for premium users securely, adhering to Payment Card Industry Data Security Standards (PCI DSS). However, no system is completely secure, and you share information at your own risk.

Your data may be transferred to and processed in countries outside your region (e.g., the United States for OpenAI or Stripe processing). We ensure appropriate safeguards, such as UK/EU Standard Contractual Clauses or adequacy decisions, to comply with UK GDPR, EU GDPR, and other laws. For US users, we comply with state laws like CCPA when transferring data.

12. Data Retention

We retain your personal data only as long as necessary to provide the App’s services or comply with legal obligations. Profile data and AI chat data are retained while your account is active and deleted within 30 days (or 45 days under CCPA) of a confirmed deletion request, unless required by law. Anonymized data may be retained for analytics purposes. Payment data processed by Stripe is retained according to Stripe’s retention policies, as outlined in their Privacy Policy.

13. Third-Party Service Providers

  • OpenAI: We use OpenAI to power our AI Soulmate and its conversational functionality. OpenAI processes your data (e.g., AI chat data) under a data processing agreement to ensure compliance with UK GDPR, EU GDPR, CCPA, and other applicable laws, including security standards like ISO 27001. OpenAI does not use AI chat data for advertising or sell it, per our agreement. See OpenAI’s Privacy Policy for details.
  • Stripe: For premium users, Stripe processes payment data (e.g., credit card details) to facilitate subscriptions or in-app purchases. Stripe complies with PCI DSS and applicable data protection laws, including UK GDPR, EU GDPR, and CCPA. We do not store your payment information. See Stripe’s Privacy Policy for details.

We recommend consulting a legal professional to verify compliance with OpenAI’s and Stripe’s data processing agreements and applicable laws.

If you are a California resident, you have the right to:

  • Know what personal information we collect, use, or disclose.
  • Request deletion of your personal information.
  • Opt out of the sale or sharing of your data (e.g., for personalized ads with Google Ads).
  • Non-discrimination for exercising your rights.

We do not sell your personal data, including AI chat data, and we do not use AI chat data for advertising purposes. We may share limited data (e.g., Advertising ID, excluding AI chat data) with third parties like Google Ads for personalized ads, which may be considered a “sale” or “sharing” under CCPA. If you are a resident of Virginia, Colorado, Connecticut, Utah, or other states with privacy laws, you have similar rights to access, correct, delete, and opt out of data processing for targeted advertising or profiling.
